Privacy Policy

The following describes the Privacy Policy in relation to the information you submit to VanClub through VanClub.net. VanClub is a program of Riverside County Transportation Commission ("RCTC"). VanClub respects your privacy. Reference herein to VanClub or VanClub.net shall be interpreted to refer to RCTC, as the operator of the program.

You are advised that the VanClub.net rideshare database is integrated with IE Commuter and San Bernardino County Transportation Authority ("SBCTA") SB Loop, which are related commuter assistance programs, and with other local commuter assistance program databases in Southern California (the "Regional Database") in order to improve regional ridematching potential for carpools and vanpools and enhance transit planning and opportunities. The following agencies (the "Other Transportation Agencies") and programs, are part of the Regional Database:

Consent

By using the VanClub.net website, you consent to the terms of this Privacy Policy and to VanClub.net's collection, use, or dissemination of Personal Information (defined below) as described in this Privacy Policy including, but not limited to, the storage and use of your Personal Information in the Regional Database.

You agree that you will not use the site or VanClub services for any unlawful activity, or in violation of the standards set forth herein.

Information Gathered

The individually identifiable information you voluntarily provide to VanClub.net, such as your first and last name, phone number, e-mail address, a home or physical address, a business address or other contact or personal information is referred to herein as "Personal Information".

Personal Information is used by VanClub.net to provide, maintain, and improve VanClub services and to fulfill requests submitted to the VanClub program and may be used to inform you of service information, promotions or other relevant information.

Your Personal Information will be stored and used in the Regional Database by VanClub and the Other Transportation Agencies. VanClub and its contractors will not disclose your Personal Information except as described below, or where disclosure is required by law. VanClub will not sell or otherwise provide your Personal Information for value received. The Other Transportation Agencies and their contractors are contractually obligated to maintain the same protections related to your Personal Information. VanClub and the Other Transportation Agencies will utilize Personal Information for the purpose of implementing and improving the VanClub program and services including, but not limited to, helping to create inter-county carpool and vanpool opportunities. Your Personal Information may also be used for implementing IE Commuter and SBCTA SB Loop, and any of the other carpool and vanpool programs identified above. This may include, but is not limited to

  1. utilizing third-party contractors to manage the Regional Database and operate VanClub services;
  2. forwarding e-mails and phone messages related to services provided by rideshare programs, transit agencies, Caltrans, or other public agencies for response by the relevant agency;
  3. utilizing your Personal Information for the IE Commuter and SBCTA SB Loop programs, and any of the other rideshare and vanpool programs identified above; and
  4. utilizing web based and telephone technologies to generate usage information and statistics in order to improve the user experience and system performance of the VanClub system and the Regional Database.

When you call into the VanClub phone system at 844.VANCLUB (844.826.2582), the system records your phone number, the date, time, and duration of your call, as well as the information you request from or provide to the system. Your call information is used to compile anonymous data to improve VanClub services. Calls inquiring about services of another agency may be transferred to the relevant agency. Once such transfer is made, the privacy policy of the agency to which the call is transferred will apply to any Personal Information provided to or collected by the agency. If you leave feedback with a Call Center agent, you may be asked to provide Personal Information so that VanClub may follow-up with your stated request or concern. You may also be asked to provide Personal Information when you provide comments to VanClub or voluntarily participate in phone surveys, troubleshooting, contests or special promotions.

The Other Transportation Agencies each have their own privacy policies, and will only use your Personal Information for purposes authorized in their policies.

It is your right not to provide Personal Information as part of VanClub web-based programs or services, however, you may not be able to use some or all of the features of certain programs or services without providing such information. You may also be asked to provide information when subscribing to an email newsletter or email alerts. VanClub may request Personal Information when you submit comments on VanClub.net or when you participate in a survey, poll or blog. VanClub may collect the following information when you visit our website: date and time, your internet location (IP address) and service provider, bytes sent and bytes received, time lapsed on website, pages visited, protocol, cookies, website referrer, and type and configuration of software you used to visit our site.

You acknowledge and agree that your participation in the programs and services offered through VanClub.net is voluntary and that you are responsible for your participation in any transportation or rideshare arrangement. You understand that VanClub, including its sponsoring agencies, and the Other Transportation Agencies shall have no responsibility or liability for any claims, expenses or damages resulting from any individual's participation. You understand that the information you provide will only be used as set forth herein. You understand that VanClub and its sponsors and the Other Transportation Agencies are subject to laws and regulations governing public agencies and acknowledge and agree that VanClub or any of the Other Transportation Agencies may be required to release your Personal Information if required by law, or court order.

Security

All VanClub employees and contractors with access to Personal Information are required to adhere to the terms of this Privacy Policy. The Other Transportation Agencies each have their own privacy policies to which they and their contractors must adhere. Personal Information collected online is stored in the Regional Database, is not publicly accessible, and is encrypted during transmittal. Personal Information is accessible by VanClub employees and authorized contractors and by employees and authorized contractors of the Other Transportation Agencies on a need-to-know basis. Once Personal Information is no longer needed, such information is deleted. Phone or e-mail inquiries about another public agency will be forwarded directly to the relevant agency; from that point forward, any Personal Information will be handled in compliance with said agency's privacy policy. While VanClub does not warranty or guarantee the security of your Personal Information, it makes all reasonable efforts to maintain such security.

Links to Other Websites

When you link to another site, you are no longer on VanClub.net and this Privacy Policy will not apply. VanClub.net provides links to other government traffic, public transit and travel related websites as a service to our customers. By providing such links, VanClub.net does not take responsibility for the information contained on those sites.

Cookies

Small files, referred to as cookies, can be placed on your computer by web servers when you visit certain sites. Cookies may contain information such as user IDs and passwords, personal information, or preferences. During your use of a site, the server can access the cookies to help personalize pages or allow you to navigate a site more easily. VanClub.net sets cookies to analyze trends and gather broad demographic information for aggregate use only within the VanClub program for analytical purposes. If you are concerned about privacy, you can delete them from your hard drive once you leave the site. When using VanClub.net, a session cookie is set as a method to maintain a secure session between a user's computer and system web servers.

Waiver of Liability and Hold Harmless

By using VanClub.net or participating in any of VanClub's programs you hereby agree to waive, release, discharge in advance and hold harmless VanClub, including its sponsoring agencies, the Other Transportation Agencies, and their directors, officers, employees, agents and affiliates from any loss, damage, claim, judgment or harm that you or anyone for which you have used the information or to whom you have provided the information, has suffered in whatever manner or form, and regardless of how the alleged loss, damage or harm is alleged to have been caused. To the maximum extent allowed by law, VanClub, including its sponsoring agencies, and the Other Transportation Agencies will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages (including without limitation any loss of profits, data, use, or goodwill) resulting or relating in any way to your access, participation, or use of (or inability to access, participate, or use) the sites or the services –whether based on warranty, contract, tort/negligence, or other legal theory–even if VanClub, RCTC, or any of the foregoing entities have been advised of the possibility of such damages. The laws of some jurisdictions may not allow the limitation of liability set forth above, so this limitation of liability may not apply to you. If any part of this limitation on liability is found to be invalid or unenforceable for any reason, the aggregate liability of VanClub.net, including its sponsoring agencies, and the Other Transportation Agencies under such circumstances for liabilities that otherwise would have been limited shall not exceed one hundred dollars ($100).

Changes

VanClub.net reserves the right to alter, change, add or delete provisions of this Privacy Policy. We will provide you with notice of any material changes by conspicuously posting notice of such changes on the VanClub.net website, by e-mail notification or by other authorized method of communication. If you do not agree to the changes, you should stop using VanClub.net services, and you may close your account by selecting "Delete My Account" on the "My Account" page or by contacting us at 844.VANCLUB (844.826.2582) or info@vanclub.net.

Services and Availability

VanClub.net services may be used by you to request and schedule transportation or logistics services with third party participants. You acknowledge and agree that VanClub and the Other Transportation Agencies do not screen, approve, hire, or employ the third party participants and you agree that VanClub and the Other Transportation Agencies have no responsibility or liability to you related to any transportation or logistics services provided to you by third party participants other than as expressly set forth in these terms. You acknowledge and agree that VanClub.net does not provide transportation or logistics services or function as a transportation carrier. The services featured on the VanClub website, unless otherwise stated, are only available within Southern California. All advertising is intended solely for the Southern California market. Users of this website are responsible for evaluating the fitness for a particular purpose of any content available through this website. Redistribution or republication of any part of this website or its content by any means is prohibited without the advance written consent of VanClub.

Log Files

Our web servers automatically log standard access information including browser type, access times, internet domain, IP address, pages visited, keywords, open mail, URL requested, and referral URL for purposes of systems administration, detecting usage patterns and troubleshooting. The foregoing information is maintained as confidential data and, except as otherwise stated herein, will not be shared with third parties. Such information is used only within the VanClub.net program for analytical purposes. IP addresses are not linked to personally identifiable information and are used to administer the VanClub.net program, track users' movement, analyze trends, and gather broad demographic information for aggregate use.

Waiver of Liability and Hold Harmless

VanClub makes no representations or warranties of any kind regarding VanClub.net and/or the content found in VanClub.net, including, with respect to the information provided by third party links, all of which are provided on an "AS IS" basis. VanClub disclaims all representations and warranties, express, implied, or statutory, not expressly set out in these terms, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. In addition, VanClub makes no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability, or availability of the services or any services or goods requested through the use of the services, or that the services will be uninterrupted or error-free. VanClub and the Other Transportation Agencies do not guarantee the quality, suitability, safety or ability of other third-party participants. You agree that the entire risk arising out of your use of the services, and any service or good requested in connection therewith, remains solely with you, to the maximum extent permitted under applicable law.

This website may contain materials, data and information which is provided, posted or offered by third parties, including third party provided content, advertisements and user oriented content. By accessing VanClub.net, you acknowledge that any use of or reliance on this website or any content shall be at your sole risk. Although VanClub.net attempts to provide a high level of service, it does not warrant that the VanClub.net service will be uninterrupted, timely or error free. Participating in the Website

VanClub.net is an online program that allows individuals to find and accept or to start new vanpooling arrangements. Use of the system is voluntary and entirely at the discretion of participants.

Vanclub.net is offered free of charge and strictly as a convenience and service to commuters seeking to join or form a vanpool. All potential vanpool users should exercise caution and discretion, and generally take whatever steps they deem necessary to ensure their personal safety. You accept full personal responsibility for any ride that you may arrange through this website. RCTC, San Bernardino County Transportation Authority ("SBCTA"), TripSpark Technologies and Trapeze Software Group accept no responsibility for actions of any individuals using the website and make no representations whatsoever regarding either the personal safety of vanpool participants or the accuracy of vanpool information.

You must be at least 18 years of age to use this Website.

Reliance Upon Information and Password

To be a registered user of VanClub.net ('Registered User') you must complete the account/profile registration process by providing us with current, complete and accurate information as prompted by the registration form ('Registration Data'). You agree to maintain and update this Registration Data as required to keep it current, complete and accurate. When you register you will create a user ID and password. You must ensure that your password is kept secure and confidential and that it is not revealed to any person. You are entirely responsible for any and all activities that occur under or through the use of your password. You agree that RCTC can reasonably rely upon any use of your password, including for our disclosure of information relating to your Registration Data. You should notify RCTC immediately if you become aware of any unauthorized use of your password or if you believe your password is no longer secret and we will cease relying on that password. You release RCTC, SBCTA, TripSpark, the Trapeze Software Group, and their officials, officers, employees and agents from any claims and won't make any claim against any of these parties relating to or arising from any reliance by RCTC upon any use of your password, including disclosing personal information relating to your Registration Data. You agree to indemnify and hold RCTC, SBCTA, TripSpark and Trapeze Software Group, and their officers and employees harmless from any claims, actions, costs (including legal costs), or losses by RCTC, SBCTA, TripSpark, Trapeze Software Group or any third party due to or arising out of reliance by them upon any acts carried out, requests made or information provided through the use of your password.

General

These Terms and Conditions shall not be amended, modified, varied or supplemented except in writing and signed by a duly authorized representative of VanClub. If any of these terms are deemed invalid or unenforceable for any reason (including, but not limited to the exclusions and limitations set out above), then the invalid or unenforceable provision will be severed from these terms and the remaining terms will continue to apply. By accessing VanClub.net and using the website services you consent to these terms and conditions and to the exclusive jurisdiction of a Superior Court or Federal District Court located within Riverside and San Bernardino Counties, California, USA, in all disputes arising out of such access. The laws of California and the United States govern these terms and conditions. Failure of VanClub to enforce any of the provisions set out in these Terms and Conditions and any Agreement, or failure to exercise any option to terminate, shall not be construed as waiver of such provisions and shall not affect the validity of these Terms and Conditions or of any agreement or any part thereof, or the right thereafter to enforce each and every provision.

Changes

VanClub reserves the right to change these Terms and Conditions. VanClub reserves the right to alter, change, add or delete provisions of these Terms and Conditions. We will provide you with notice of any material changes by conspicuously posting notice of such changes on VanClub.net, by e-mail notification or by other authorized method of communication. If you do not agree to the changes, you should stop using VanClub.net services, and you may close your account by selecting "Delete My Account" on the "My Account" page or by contacting VanClub staff at 844.VANCLUB (844.826.2582) or info@vanclub.net. If you are a Coordinator, Primary Driver, Back Up Driver or Reporter and the vanpool you participate in is actively receiving a subsidy from RCTC and you wish to remove your information, you will have to terminate your participation in the program.

The continued use of this website will signify acceptance of any such changes. Accessing this website indicates agreement to and acceptance of these Terms and Conditions. VanClub may terminate, change, suspend or discontinue any aspect of VanClub.net, including eliminating, adding, altering or otherwise changing any features and/or content at any time without notice or liability. VanClub reserves the right, but shall not be obligated, to correct any errors or omissions in any portion of VanClub.net at any time without notice to any VanClub.net user or third party linked to the website.
